ELDAC Website Terms and Conditions

The ELDAC Website is hosted by Flinders University. The ELDAC Website is comprised of various web pages managed by the ELDAC Project Team, College of Nursing and Health Sciences, Flinders University. The ELDAC Website is offered on the terms and conditions contained here (hereafter ‘Terms and Conditions’). Flinders University reserves the right to change these Terms and Conditions at any time. By using the ELDAC Website you acknowledge, accept, and agree to be bound by, these Terms and Conditions.

 

Content

Although the ELDAC Project Team has attempted to ensure the information published on the ELDAC Website (including, but not limited to, written text, photographs, diagrams, all articles, research data, surveys, forums/chat rooms and commentary, hereafter 'Information') is as accurate and complete as possible, the Information may change from time to time. This may be because further research is developed and becomes available. Practice may also vary according to what is available locally (e.g. particular medications) and the experience and expertise of health professionals. In addition, the Information is necessarily of a general nature, and you should use your best judgement in the way in which it is used. You should seek independent professional advice as required.

You will not use the ELDAC Website for any purpose that is unlawful or prohibited by these Terms and Conditions. You will not use the ELDAC Website in any manner which could damage, disable, overburden, or impair the ELDAC Website or interfere with any other party's use and enjoyment of the ELDAC Website. You will not obtain or attempt to obtain Information or access to the ELDAC Website through any means not intentionally made available or provided for through the ELDAC Website. 

 

Privacy

The Privacy Act 1988 (hereafter ‘the Act’) and the Australian Privacy Principles generally apply to the private sector and all health service providers. Flinders University supports and endorses the Act and the Australian Privacy Principles.

Notwithstanding this, you should be aware that there are inherent risks associated with the use of the Internet for the transmission of personal or private information. Flinders University disclaims any liability for such risks to the extent that they are outside of our reasonable control.

The ELDAC Project Team will only record your email address and personal information when you:

  • Send us a message;
  • Complete a feedback form;
  • Provide information for the ELDAC Website.

Your email address and personal details will only be used by us for the purpose for which you have provided it. Your email address will not be added to any mailing lists without your permission. The ELDAC Project Team will not give anyone else your email address or any other personal details provided by you, unless you consent to this in writing, or we are required to do so by law.

When you visit the ELDAC website, the website automatically logs, for statistical purposes, some or all of the following information about your visit:

  • The name or number which uniquely identifies the computer making the connection to this website (IP address);
  • The address of the referring website;
  • The date and time of your visit;
  • Your top level domain name (e.g. .gov, .uk, .au, etc.);
  • The address of the page accessed and any files downloaded;
  • The type of browser you used.

No attempt will be made to identify you or your browsing activities except where required by law.

Please note that the ELDAC Website uses cookies to maintain session information between web pages. 

Google Analytics is used to analyse traffic to this website. Google Analytics does not maintain individual profiles for visitors, nor does Google Analytics collect data that might identify you. ELDAC is an information partner of healthdirect, an Australian Government initiative. This partnership reflects a shared vision to provide relevant and reliable health and related information to Australian consumers.

 

Copyright

The Information authored by or on behalf of the ELDAC Project Team and published on the ELDAC Website is subject to all Flinders University intellectual property rights arising under law and statute, including the Copyright Act 1968. Permission is given for you to view, print and use the Information via the internet and in electronic form, provided that it is for personal, domestic or genuine research purposes only and for purposes associated with the use of the ELDAC Website (for example, a discussion forum). Flinders University do not give permission for any use of the ELDAC Website and the Information for commercial purposes.

No Information authored by or on behalf of us may be copied, modified or reproduced in any way without our written permission.

The ELDAC website also publishes Information authored by other parties. The ELDAC Project Team have made every effort to contact those authors or others who may have intellectual property rights, including copyright, in material in the literature database published on the ELDAC website. Please contact eldac.project@flinders.edu.au if you believe that any copyright material has been used on the ELDAC website without the permission of the author.


Training Materials

Online training materials can be of value to Australian palliative care practitioners, but such materials are not intended to replace formal education and training. From time to time, the ELDAC Project Team may publish such materials on the ELDAC website. However, your use of online training materials should not be considered as a qualification in palliative care. No formal accreditation is offered via our website.

The ELDAC Project Team uses reasonable endeavours to review the source of the materials and to assess the credibility and qualifications of the author or organisation involved.

 

Funding, editorial control and advertising

The ELDAC Website is funded by the Australian Government Department of Health and Aged Care. The funding is provided to enable the provision of evidence based resources, toolkits, information and materials to the aged care industry and primary care sector. The funder does not influence editorial policies or quality processes.

ELDAC is not influenced by sponsorship, and express advertising or implied endorsement for any commercial products or services is strictly prohibited. Reference on the ELDAC Website to any specific commercial products, process, service, manufacturer, company, or trademark does not constitute its endorsement or recommendation by ELDAC

The ELDAC website may contain pop-up advertisements. These advertisements were not produced by ELDAC and most likely produced by other websites you visited or by third-party software installed on your computer. ELDAC does not endorse or recommend products or services for which you may see a pop-up advertisement on your computer screen while visiting the ELDAC Website, All material contained within the advertising, and on any pages to which it is linked, is completely independent of  ELDAC and in no way represents our interests or policies.

The ELDAC Website may contain links to other websites (‘Linked Websites’). The Linked Websites are not under the control of ELDAC and ELDAC is not responsible for the contents or condition of any Linked Website, including without limitation any link contained in a Linked Website, or any changes or updates to a Linked Website. ELDAC is providing these links to you only as a convenience, and the inclusion of a link does not imply endorsement by ELDAC of the Linked Website or any association with its operators. By using a Linked Website, you will be subject to the Linked Website’s terms and conditions.

 

Collaborative content

The ELDAC Website may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities (hereafter collaborative content). The collaborative content may be conducted via a moderator who can stop or edit the information being shared. Unless explicitly stated, the collaborative content is un-moderated, however, ELDAC may nevertheless monitor the un-moderated forums to endeavour to ensure accuracy of information and provide assistance to you when necessary. ELDAC may – without being obliged to - voluntarily contribute to existing discussion threads, or initiate new threads of discussion.

The general approach to forums will be to establish an open, interactive discussion and to avoid censoring legitimate and relevant messages or opinions, but ELDAC reserves the right to edit and/or remove inappropriate messages or opinions, or to lock a discussion thread.

With regard to the quality of content of forums, responsibility rests with the moderator and/or the participants. Opinions expressed in the forum are those of the participants only, and ELDAC is not responsible for any such opinions.

When using Forums you agree to follow any instructions and directions issued by ELDAC at all times. You must give the source of all information and materials when it is not personal experience or general knowledge. Personal experience is any symptom, test, treatment etc. that the person or a close family member has undergone himself/herself. All statements about statistics, data, studies and new advancement in medicine should have trustworthy sources.

Examples of what you will not do when using a forum or blog includes, but is not limited to:

  • Defaming, abusing, harassing, stalking, threatening or otherwise violating the legal rights (such as rights of privacy and publicity) of others.
  • Publishing, posting, uploading, distributing or disseminating any illegal, inappropriate, profane, defamatory, infringing, obscene or indecent, material, photographs, pictures, graphics, videos, moving visual images or information.
  • Uploading files that contain software or other material you do not own, control the rights to or have received all necessary consents.
  • Uploading files that contain viruses, corrupted files, or any other software or programs that may damage or impair the ELDAC Website or operation of another's computer.
  • Conducting commercial activity or advertising or offering to sell or buy any goods or services, unless the collaborative content specifically allows such messages.
  • Conducting or forwarding surveys, contests, pyramid schemes or chain letters.
  • Downloading any file posted by another user of collaborative content that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsifying or deleting any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restricting or inhibiting any other user from using and enjoying the collaborative content
  • Violating any code of conduct or other guidelines which may be applicable.
  • Harvesting or otherwise collecting information about other users of the collaborative content and the ELDAC Website.

You grant ELDAC permission to:

  • Use, which may include, but not limited to, publishing, broadcasting, distributing, disseminating, transmitting, displaying, publicly performing, reproducing, anything you publish or upload to collaborative content for any purpose and in any form whatsoever and language;
  • Omit you as the author, creator or source of collaborative content; and
  • Use your collaborative content without providing any financial or in-kind compensation.


Liability

To the maximum extent permitted by law, ELDAC provides no warranties, express or implied, and accepts no responsibility for the Information, including but not limited, the accuracy or completeness of the Information or fitness of the Information for any purpose.  ELDAC assumes no liability or responsibility for any loss or damage resulting from any use of the ELDAC website or Information.

You agree to indemnify ELDAC from and against any law suits, claims, losses, costs and damages that the ELDAC incurs or suffers relating to or arising from your use of the ELDAC Website or your breach of these Terms and Conditions.


Termination

ELDAC reserves the right, in its sole discretion, to terminate your access to the ELDAC Website.


Ownership

Unless otherwise stated in these terms and conditions, Flinders University claims ownership of the ELDAC Website, the Information, and the copyright, intellectual property and trademarks contained on the Website.

This website is authorised by Professor Jennifer Tieman, Palliative & Supportive Services, Flinders University. Editorial control is exercised by the ELDAC Project Team, details of which can be found in the ‘About Us’ page.

Jurisdiction

These Terms and Conditions are governed by the laws applicable in the South Australia and you agree submit to the non-exclusive jurisdiction of the courts of the State of South Australia.
